Areas of Practice

  • Estate Planning

Correctly planning your death and incapacity is typically not at the top of most people’s to-do lists. However, good planning will provide you with peace of mind knowing your loved ones are correctly provided for. We want to help you create the best estate plan possible. Whether you have a large or a small estate, you should be sure your wishes are followed upon your death and that you and your assets are protected in the event of your incapacity.

  • Guardianships

A court appoints a legal guardian for those who cannot care for their well-being due to incompetence. Guardianship is the legal process of naming someone accountable for an individual’s personal affairs after a determination is made the individual (known as the “ward”) is no longer capable of managing his/her own affairs. We can assist the effort to help loved ones who have lost the ability to help themselve by obtaining proper authority through Guardianship proceedings.

  • Medicaid Planning

Medicaid can help pay for your loved one’s long-term care. Long-term care can be very expensive, sometimes exceeding $10,000 per month for nursing home care. Few can afford to pay these costs for any length of time. The good thing is that our social safety net extends Medicaid to help pay for long-term care for our elderly and disabled population. Medicaid can help pay for the applicant's nursing home, assisted living facility or in-home care. Accessing Medicaid for your loved one’s long-term care can be confusing and difficult in the best of circumstances. Hiring an elder law attorney to assist you and your loved one's Medicaid application can be integral to the process.

  • Probate and Trust Estate Administration

When a loved one passes away, his or her estate often goes through a court-managed process called probate administration where the assets of the deceased are managed and distributed with the oversight of the local Probate Court. If your loved-one owned his or her assets through a well drafted and properly funded living trust, it is likely that no court-managed administration is necessary, though a successor trustee of the trust will need to administer the distribution of the deceased's assets in accordance with the terms of the trust. Whether an individual passes away with a trust, just a Will, or with no planning documents in place, we are here to assist with the myriad of issues facing the party responsible for administering the decedent’s estate.
